In the list of panel members, Nkabane falsely claimed legal expert advocate Terry Motau was part of it. She later apologised, saying it was a misunderstanding. The Democratic Alliance has laid criminal charges against Dr. Nkabane after she misled the Portfolio Committee on Higher Education over appointments of the chairperson of the SETA boards and regarding her independent panel.
